The plaintiff, JOHN FRANKLIN HAMMONS, who sues by his guardian and next friend, ELIZABETH J.HAMMONS, says that on the day of 1863, JAMES HAMMONS did domicile in Knox County. That at the death he left as his heirs at law, his widow, POLLY HAMMONS; CLAIBORN JONES & HARRIET JONES, his wife, formerly HARRIET HAMONS DANIEL STEWART and THURSY his wife, formerly THURSY ANN HAM MONS ; BENJAMIN POWELL and MARTHA, his wife, formerly' MARTHA HAMM0NS ; SA 3L DICKEY and MARY, his wife, formerly MARY HAMMONS, JAMES JONES and SARAH E. JONES, formerly SARAH E., HAMMONS;CATHERINE HAMMONS, who since married WM. WARREN; VIRGINIA HAMMONS, who has since married WILEY A. BROUGHTON; WILLIAM HAIMMONS; JAMES HAMMONS; JOHN HAMM0NS, and the plaintiff, JOHN F. HAMMONS who is the only son and heir of DANIEL HAMMONS by ELIZABETH JANE, his wife.
That DANIEL HAMMON was son of JAMES HAMMONS, deceased, and died previous to his father's death on the __day of February, 1863. That plaintiff is entitled in the distribution of JAMES HAMMONS' estate to all that his father, DANIEL, would be, if living, which is one-eleventh part.
That since the death of said JAMES HAMMONS, THURSY A. STEWART has died leaving as her children and heirs atlaw:GREEN,DANIEL,DICKEY,FRANK,DEMCY,and ROSA ANN DICKEY, all of whom are infants under the age of 21 years.
That at the time of his death, JAMES HAMMONS was the owner of a certain tract of land conveyed to him on the 10th day of March 1838 by OBEDIAH HAMMONS. Plaintiff further says that his mother is poor; that his father left very little property and that his interest in said estate of JAMES HAMMONS is necessary for his support and education, etc., etc.
DUTTON JONES listed as a defendent, bought land from several of the heirs. ELIZABETH J. HAMMONS was making all the above statements October 1, 1867.
JAMES BROUGHTON states in a deposition that he was acquainted with DANIEL HAMMONS who was the son of JAMES HAMMONS, deceased, and was also acquainted with his widow, ELIZABETH HAMMONS. Also states DANIEL and ELIZABETH have one child living, to wit: JOHN F. HAMMONS, some eight or nine years old. Says he understands JOHN F.HAMMONS has an interest in the estate of his grandfather, JAMES HAMMONS, deceased.
